These Terms of Service (“Terms”) govern your access to and use of MyBench (the “Service”), operated by Nathaniel Sands, a sole proprietor based in New Hampshire, United States (“we”, “us”, or “our”). TIWIG MyBench is the name used for the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using MyBench you represent that you are 18 or older and that your reloading, handloading, and firearms-related activity is lawful in your jurisdiction. You are solely responsible for complying with all applicable federal, state, and local laws.
2. Accounts
You are responsible for the activity that happens under your account and for keeping your login credentials secure. Notify us promptly at natinnh@gmail.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Subscriptions, billing & refunds
MyBench offers a free tier and a paid Pro subscription. Paid subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on each renewal until you cancel.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price.
- Cancellation. You may cancel at any time from your account settings or billing portal. Cancellation stops future renewals; your paid features remain active until the end of the period you have already paid for.
- Refunds. Payments are non-refundable and we do not provide partial or prorated refunds for unused time, except where required by law.
- Price changes. We may change subscription prices. Any change applies to future billing periods, and we will give you reasonable advance notice.
- Failed payments. If a renewal payment fails, we may retry the charge and may downgrade or suspend paid features until payment succeeds.
4. Reloading & firearms safety disclaimer
Reloading ammunition is inherently dangerous and can cause serious injury, death, or property damage. You are solely responsible for verifying every load against authoritative published sources, for working up loads safely, and for the safe storage and handling of firearms, ammunition, and components. You assume all risk arising from your reloading and firearms activity. To the fullest extent permitted by law, Nathaniel Sands is not liable for any injury, damage, or loss resulting from your use of, or reliance on, any information in the Service.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems;
- Interfere with, disrupt, or overload the Service, or circumvent usage limits, access tiers, or security controls;
- Reverse engineer, scrape, or resell the Service except as permitted by law;
- Upload malicious code or content that infringes the rights of others.
6. Your content & data
You retain ownership of the data and content you create in MyBench (your firearms, components, recipes, chronograph data, files, and other records). You grant us a limited license to store, process, and display that content solely to operate and provide the Service to you. We do not claim ownership of your content and we do not sell it. You can export or request deletion of your data as described in our Privacy Policy.
7. Our intellectual property
The Service, including its software, design, and branding, is owned by Nathaniel Sands and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy or redistribute the Service.
8. Third-party services
The Service relies on third parties, including Stripe (payments), our hosting provider, and, where you enable them, Google sign-in and calendar sync and AI features. Your use of those integrations may be subject to their own terms. We are not responsible for third-party services we do not control.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data or calculation is accurate or complete.
10. Limitation of liability
To the fullest extent permitted by law, TIWIG and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.
11. Indemnification
You agree to indemnify and hold harmless TIWIG from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or of any law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including the disclaimers, limitation of liability, and indemnification) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in New Hampshire, and you consent to their jurisdiction.
